Understanding Chapter 13 Bankruptcy

Under Chapter 13 you will be required to pay a portion of your debt , that amount is worked out in your filing plan. The creditors are sent copies of your bankruptcy plan and can file forms with the court asking that you pay more than you want to pay.  The Bankruptcy Court will make the final decision on amount and time frame.

This whole process simply tries to determine who all you owe , how much you earn and how much you should pay back and what amounts . You will be filling out forms , lots of forms and you need to honest , if the Courts find you are hiding assets or other income you will pay far more than if you had just been honest upfront.

Under the new Bankruptcy law you will be required to meet with a credit counselor
